Almost Dead, Tennessee’s SNAP Waiver Now on Life Support

Yesterday the U.S. Department of Justice filed, on behalf of Secretary of Agriculture Brooke Rollins, a notice that it will appeal the judgement that vacated SNAP waivers in Tennessee and four other states. The notice came in just under the wire, as the government had until midnight tonight to signal its intent to appeal.
There are no details yet about when the court will take up the case, or when it might be decided. The appeal notice will be transmitted to the Court of Appeals for the D.C. Circuit which, after some preliminary filings, will set a briefing schedule.

TGCSA is committed to protecting the SNAP retailers of Tennessee from burdensome and expensive rules and regulations. Should the government’s appeal eventually succeed, TGCSA will urge the state to redesign its original waiver application that would obligate the state to provide uniform standards and resources to help SNAP vendors comply with the new rules.
